Back in November No Doubt filed a lawsuit against Activision over the use of its likeness in Band Hero. Now Activision has filed a countersuit saying No Doubt is failing to live up to contractual obligations to promote the game.
“The band [members] are bitterly disappointed that their name and likeness was taken and used without their permission,” No Doubt manager Jim Guerinot previously said.
The Hollywood Reporter now claims that Activision has accused the group of failing to do its due diligence before signing away its digital likeness. No Doubt is said to be unhappy with its digital representation in Band Hero due to their in-game avatars doing things out of character.
Activision admits that Band Hero allows consumers to unlock in-game characters and adds that this has been a feature of the games since the Guitar Hero franchise began. The publisher claims that No Doubt is failing to live up to contractual obligations to promote the game while at the same time obtaining benefits from its inclusion in the title.
