Liberty Mutual Fire Insurance is suing Redmond, Wash.-based Nintendo of America over a fire allegedly started by a faulty Nintendo DS charger.
A court filing dated December 17 said the home of Liberty client French Harmon sustained "substantial damage" from a January 2007 fire said to be caused by a charger connected to a DS.
Liberty paid $236,304 to Harmon to cover the cost of the fire. The insurance company is seeking the same amount plus interest and legal fees.
The suit, which accuses Nintendo of negligence, said the game maker supplied "a dangerous and defectively designed, manufactured and/or assembled product which it knew, or should have known, created an unreasonable risk of harm by fire."
Liberty noted that Nintendo had issued a recall for DS adapters, although the suit didn't specify that the recall was confined to 200K units in Japan. No recall had occurred in the U.S.
