EDIT 16/12 - Bethesda has provided the following statement:
"This is a legal proceeding and we don't comment publicly on the specifics of the dispute. The court has declined to decide the issues at a preliminary hearing, and determined that the parties should maintain the current status quo pending a trial of the case in 2010. We are confident that we will prevail on our claims against Interplay."
Gamasutra reports that Interplay will be able to continue selling Fallout Trilogy, a bundle of Fallout, Fallout 2 and Fallout Tactics, along with the titles on an individual basis. Interplay will also be able to continue work on its Fallout MMO.
Bethesda attempted to sue Interplay in September this year, claiming that it had not approved cover art for Fallout Trilogy and that it might be confused with the cover of Fallout 3. The dispute also affected Interplay's Fallout MMO, with Bethesda claiming that Interplay had failed to meet the required conditions in order to continue to hold onto the Fallout licence.
The conditions included the terms that Interplay should be in full-scale development of the MMO by April 4 2009 and have secured at least US$30 million in funding.
Bethesda became the sole owner of the Fallout IP in 2007 after a USD5.75 million deal with Interplay.
