Nintendo Wins Australian DS Piracy Suit

Federal Court orders R4 distributor to pay platform holder over half a million dollars for selling piracy tool.

The Federal Court of Australia has ordered a local distributor to pay Nintendo $520,000 in damages for selling the R4 mod chip.

It also ruled that RSJ IT Solutions must cease selling the device, which allows users to circumvent Nintendo’s technical prevention measures.

Two individuals also named in the case, Patrick Li and James Li, were told they must pay Nintendo an additional $100,000 in penalties, reports IT News.

Earlier this month an Australian citizen was ordered to pay Nintendo $1.5 million in damages after illegally copying and uploading to the internet the first game file of New Super Mario Bros. Wii.

Last year Nintendo, Capcom and 53 DS software manufacturers filed a lawsuit in the Tokyo District Court against four companies alleged to have been importing and selling the R4 game copying device.
