Los Angeles Superior Court Judge Craig Karlan has said that he is not inclined to delay the release of EA and Double Fine’s Brutal Legend, as requested by Activision, but delayed a formal ruling until next week.
Karlan told attorneys for Activision that he was leaning in Double Fine’s favour, but also noted that the decision is “going to be a close call," according to an Associated Press report.
In a lawsuit earlier this year Activision claimed that Double Fine improperly transferred rights to the game owned by the publisher to its rival EA, which plans to release the Jack Black-starring title in October
In a subsequent counterclaim, Double Fine argued that Activision relinquished its rights to the game prior to the developer signing with EA, and accused Activision of attempting to kill off a project it sees as a threat to sales of its Guitar Hero franchise.

I though before that EA was a tough company but now it seems Activision has taken the title.

I cannot, but my work has an uber-strict filter and I can hardly get any videos, except MSNBC's.
